Subject Matter of the Contract<\/h4><p>These General Terms and Conditions for Services provided by the European Institute of Quantitative Finance (hereinafter: EIQF) govern the provision of services within the framework of the \u201cExpert in AI and Finance\u201d program.<\/p><p>The program provider is the EIQF, which is responsible for its academic direction.<\/p><p>The contracting parties are the EIQF and the participants admitted to the examination.<\/p><h4>2. Registration, Formation of the Contract<\/h4><p>Registration for participation in the program may be made in writing by mail or online by the participant filling out and submitting the registration form. The contract is formed upon receipt of a confirmation of registration from the EIQF.<\/p><h4>3. Services<\/h4><p>(1) The course participant receives at least the following services from the European Institute of Quantitative Finance (EIQF):<\/p><ul class=\"list-normal\"><li>Personal guidance from the lead professors<\/li><li>Feedback on learning progress<\/li><li>Videos on the topic of AI and Finance<\/li><li>The models featured in the videos<\/li><li>Additional materials on the topic of \u201cAI and Finance\u201d<\/li><li>\u201cExpert in AI and Finance\u201d certificate<\/li><\/ul><p>(2) Upon passing the exams listed in the examination regulations, the EIQF awards the title \u201cExpert in AI and Finance\u201d (or, for Steps 1 and 2, a corresponding designation is listed) and issues the corresponding certificate.<\/p><p>(3) The title \u201cExpert in AI and Finance\u201d is awarded by the European Institute of Quantitative Finance. The holder of the title may not make any modifications to the title. In the event of a violation, third parties (e.g., other educational providers) may assert claims against you. The European Institute of Quantitative Finance reserves the right to change the title \u201cExpert in AI and Finance\u201d at any time and to award a different title in the future upon successful completion of the corresponding examinations. Participants who have already been awarded the title \u201cExpert in AI and Finance\u201d shall thereafter have the right to continue using either the old title or the new title. Any further claims against the EIQF are hereby excluded.<\/p><p>(4) Retake exams are governed by the examination regulations.<\/p><h4>4. Fees<\/h4><p>The participation fees for the Expert in AI and Finance program are as follows:<\/p><ul class=\"list-normal\"><li>EAIF Step 1: \u20ac185 incl. 19% VAT<br>(Net amount \u20ac155.46, VAT included \u20ac29.54).<\/li><li>EAIF Step 2: \u20ac450, including 19% VAT.<br>(Net amount \u20ac378.15, VAT included \u20ac71.85).<\/li><li>EAIF Step 3: \u20ac635, including 19% VAT.<br>(Net amount: \u20ac533.61; VAT included: \u20ac101.39).<\/li><\/ul><h4>5. Terms of Payment, Default, Termination<\/h4><p>(1) Upon confirmation of registration, the EIQF will send the customer an invoice for the examination fee. Invoices from the EIQF are due immediately upon receipt without any deductions and must be paid within four weeks of the due date.<\/p><p>(2) Only participants who have paid the examination fee will be admitted to the examination.<\/p><p>(3) If the examination fee is not paid by the due date, the EIQF is entitled to terminate the contract.<\/p><p>(4) Failure to achieve the educational objective (such as failing exams) does not entitle the participant to a reduction in fees. Furthermore, the failure of third parties to provide expected subsidies for educational expenses does not constitute grounds for the participant to legitimately refuse payment.<\/p><p>(5) In the event of default by the customer, the EIQF is entitled to claim default interest in accordance with the Act on the Acceleration of Due Payments. Any additional claims for damages remain unaffected by this provision.<\/p><p>(6) The participant may set off claims against EIQF\u2019s claims only if the customer\u2019s counterclaim is undisputed or a legally enforceable judgment has been issued.<\/p><h4>6. Cancellation, Changes, and Rescheduling of Events<\/h4><p>(1) The EIQF reserves the right to cancel events for reasons beyond its control. Any payments already made by the participant to the EIQF will be refunded in full. Any further claims by the participant are excluded; in particular, the participant has no right to have the exam administered.<\/p><p>(2) The EIQF will inform the participant immediately if there is a change in the time or location of the exam.<\/p><h4>7. Cancellation Policy \/ Right of Withdrawal<\/h4><p>If the participant is a consumer and not a businessperson, they are entitled to a right of withdrawal pursuant to \u00a7 312b BGB and \u00a7 312d BGB in conjunction with \u00a7 355 BGB. The contract may be canceled in writing (e.g., by email or letter) within 14 days without stating a reason. The period begins upon receipt of this notice in writing, but not before the contract is concluded and not before the information obligations pursuant to Article 246 \u00a7 2 in conjunction with \u00a7 1 (1) and (2) of the Introductory Act to the German Civil Code (EGBGB) have been fulfilled. To comply with the withdrawal period, it is sufficient to send the notice of withdrawal in a timely manner. The notice of withdrawal must be addressed to:<\/p><p>European Institute of Quantitative Finance (EIQF) GmbH &amp; Co. KG (EIQF)<br>Neckarsteige 6-10<br>D-72622 N\u00fcrtingen<br><a href=\"mailto:info@eiqf.de\">info@eiqf.de<\/a><\/p><p>The EIQF\u2019s obligation to perform arises only after the expiration of the withdrawal period. The right of withdrawal expires prematurely if, with the participant\u2019s express consent, the EIQF has begun to perform the service or if the participant has initiated the performance of the service themselves.<\/p><h4>8. Copyrights, Rights of Use<\/h4><p>(1) The EIQF reserves all rights, including those to translate, reprint, and reproduce the materials\u2014including as electronic documents (e.g., in video and PDF formats)\u2014and learning programs, or parts thereof. No part of the materials may\u2014not even in part\u2014be reproduced, processed, modified, distributed, or otherwise used for public dissemination without the written permission of the EIQF.<\/p><h4>9. Liability<\/h4><p>(1) The EIQF is liable exclusively in cases of its own willful misconduct or gross negligence. Liability for simple negligence is possible only in the event of a breach of an obligation so essential to the contract that the achievement of the contract\u2019s purpose is jeopardized, as well as in the event of injury to life, limb, or health. In such cases, the EIQF is liable to participants solely for compensation for damages that were typical and foreseeable, and the amount of such compensation is limited to the participant fee.<\/p><p>(2) The EIQF shall not be liable for the loss, damage, or destruction of the participant\u2019s property in connection with the conduct of the program, unless such loss, damage, or destruction is attributable to intentional or grossly negligent conduct on the part of the EIQF. Furthermore, the EIQF shall not be liable for personal injury or property damage occurring during travel to and from the program or at the program venue.<\/p><p>(3) The EIQF shall not be liable for damages resulting from force majeure, civil unrest, war, natural disasters, or other events beyond its control (e.g., strikes, lockouts, traffic disruptions, orders issued by domestic or foreign government agencies) or from technical malfunctions\u2014such as those affecting the IT system\u2014that are not caused by its fault. Computer viruses or intentional attacks on IT systems by \u201chackers\u201d shall also be considered force majeure, provided that appropriate protective measures against such incidents have been taken in each case.<\/p><p>(4) Upon conclusion of this contract, you permanently release the EIQF from any liability, claims, or damages that you might otherwise assert against the EIQF based on your registration.<\/p><p>(5) You agree that you use the EIQF\u2019s services at your own risk. The EIQF does not guarantee that the services will be available without interruption or free of errors. The EIQF disclaims all warranties of any kind. These include, among others, warranties of fitness for a particular purpose, warranties of merchantability, and warranties of non-infringement of the rights of others. The EIQF does not guarantee the accuracy or completeness of information on the EIQF websites or of information provided in connection with the EIQF websites. The EIQF is not liable for errors or omissions, nor for the results obtained from the use of this information. The content of the \u201cExpert in AI and Finance\u201d program is not to be construed as a recommendation to purchase specific financial instruments or securities, to acquire, in whole or in part, companies analyzed as part of the course, or to make investment decisions of any kind. The EIQF assumes no liability for actions taken as a result of the course.<\/p><p>(6) To the extent that the EIQF\u2019s liability is excluded or limited, this also applies to its employees, representatives, and agents.<\/p><h4>10. Data Protection<\/h4><p>(1) The participant is hereby informed, in accordance with the Federal Data Protection Act, that the EIQF will store the participant\u2019s full address and other order-specific details in machine-readable form and process them automatically for purposes arising from the contract. The EIQF guarantees that this data will be treated confidentially.<\/p><p>(2) The EIQF undertakes to treat the personal data provided to it by the participant as confidential and not to disclose it to third parties.<\/p><h4>11. Governing Law and Jurisdiction<\/h4><p>(1) This agreement is governed by the laws of the Federal Republic of Germany.<\/p><p>(2) The place of jurisdiction for all disputes arising from the contractual relationship is Frankfurt am Main.<\/p><h4>12. Written Form and Continued Validity of the Contract<\/h4><p>(1) The parties agree that any amendments or additions to the terms of the contract must be made in writing. This also applies to the written form requirement pursuant to this Section 12 of the General Terms and Conditions.<\/p><p>(2) Should any provision of this contract be invalid, the validity of the remaining provisions shall remain unaffected.<\/p><h4>13. Disclaimer<\/h4><p>(1) The \u201ctools\u201d on the Campus were created by the two directors of the European Institute of Quantitative Finance (EIQF), \u201cProf. Dr. Dr. Dietmar Ernst\u201d and \u201cProf. Dr. Dr. Joachim H\u00e4cker.\u201d The European Institute of Quantitative Finance is an affiliated institute of N\u00fcrtingen University of Applied Sciences. The EIQF awards the title \u201cExpert in AI and Finance.\u201d<\/p><p>(2) Pursuant to Section 1 of the UrhG (Law on Copyright and Related Rights (Copyright Act)), the authors of scientific works are entitled to protection for their works in accordance with this law. Pursuant to Section 2(2) of the UrhG, a work exists if it constitutes a personal intellectual creation. Section 69a of the UrhG applies to software, such as the Excel files provided here. Thus, copyright law applies to software. Any computer program that is statistically unique is protected. All of these requirements apply to the Campus tools, and therefore the tools are protected by copyright law.<\/p><p>(3) You will gain access to the tools upon registering for the Expert in AI and Finance program. The tools are intended solely for your personal use. If you share the tools with third parties, use parts of them or the entire tool without authorization, and fail to indicate such use and credit the copyright holder, EIQF, you will be in violation of applicable copyright law and may be subject to criminal prosecution. You should expect that EIQF will assert claims against you and take legal action against you.<\/p><p>(4) The unauthorized use of copyrighted works may be punishable by up to three years\u2019 imprisonment under Section 106 of the German Copyright Act (UrhG). Pursuant to Section 108b of the German Copyright Act (UrhG), unauthorized circumvention of technical protection measures and unauthorized access to information necessary for the enforcement of rights may be punishable by up to one year of imprisonment.
